Scope of application

This Policy covers the processing, by automated or non-automated means, of all personal data, including the processing of special categories of personal data, carried out by Nextbitt, as the entity Responsible for Processing.

All personal data relating to special categories of personal data will be processed with increased diligence by Nextbitt. Both categories will also be referred to as "Personal Data" in this Policy, unless otherwise indicated.

Privacy and Personal Data Protection

a. Processing operations on your Personal Data

In accordance with data protection legislation, your Personal Data is processed by Nextbitt:

Nextbitt may share Data Subjects' Personal Data with Subcontractors provided that this is necessary for the normal provision of its services.

The relationship established between Nextbitt and the Subcontractors is, under the terms of the data protection legislation in force, regulated by a contract that binds the Subcontractor to Nextbitt, establishing, with regard to Personal Data, the object, duration, nature and purpose of its processing, the type of personal data and the categories of data subjects, as well as Nextbitt's obligations and rights.

The same contract also stipulates the obligations of the Processor referred to in the General Data Protection Regulation (EU Regulation 2016/679 of the European Parliament and of the Council of April 27, 2016).

b. Purposes and grounds for lawfulness of Personal Data Processing operations of:

Nextbitt carries out processing operations on your Personal Data in order to ensure compliance with the service contract agreed with the Data Subjects or with the Joint Controllers (in relation to the data and Data Subjects collected by them, such as counterparties, employees and others). The Personal Data identified herein and subject to processing operations, are under a situation of need for the performance of a contract or for pre-contractual steps or for the fulfillment of legal obligations, or, in the case of marketing, may be under consent.

The processing of Personal Data will be carried out in an appropriate manner, to the extent that it is necessary for reasons of important public interest such as the prevention of money laundering and terrorist financing, in compliance with applicable legal obligations, or, if necessary, with the explicit consent of the Data Subject.

c. Sharing your Personal Data with the following Recipients:

Nextbitt's service providers, particularly in the areas of IT, technical and operational support;

Nextbitt Group or related entities;

Judicial bodies, criminal police bodies and administrative authorities.

d. Retention of Personal Data

Nextbitt keeps Personal Data for the period that is deemed necessary and sufficient for the purposes for which it was processed, with the period of time for which Personal Data is kept varying according to the purpose for which such Personal Data is processed and also according to the applicable legal rules on the legal periods for keeping Personal Data.

Once these periods have elapsed, the Personal Data will be deleted, subject to appropriate technical and functional guarantees, as documented in each of the relevant processes.

e. Data subjects' rights

Data Subjects have the right of access to Personal Data concerning them, as well as the right to rectification or erasure, the right to restriction of processing, the right to object to processing and the right to portability of their Personal Data.

Data Subjects also have the right to withdraw their consent at any time if the processing in question is based on consent given; as well as the right to lodge a complaint with the supervisory authority, the National Data Protection Commission.
